Enterprise dissolution and the shortcomings of the 2020 Law on Enterprises

Abstract

This article provides analysis and assessment of the rules on enterprise dissolution under the 2020 Law on Enterprises. Specifically, the article studies the positive changes in provisions regarding enterprise dissolution under the 2020 Law on Enterprises in comparison with the 2014 Law on Enterprises. At the same time, the limitations and shortcomings which have caused difficulties for both enterprises and state agencies during the enterprise dissolution process are also analyzed and evaluated. The article then proposes some suggestions to refine provisions of the 2020 Law on Enterprises regarding enterprise dissolution.
