Abstract

Economic concentration in some cases can cause negative impacts on competitive environment. Thus, competition law needs to intervene in order to promptly prevent economic concentration cases that have an impact or are likely to have an impact on competition, and at the same time handle violations of enterprises during the economy concentration process. However, legal provisions on investigation and handling of violations on economic concentration still contain several inappropriate points that need to be addressed and improved. In this article, the authors analyze the process of receiving, investigating and handling violations of economic concentration provisions in the Law on Competition 2018, revealing inadequacies and unreasonableness in the investigation and handling process, thereby propose directions for improving the investigation and handling of cases of violations on economic concentration.
