Abstract

The article analyzes the philosophies in treatment of juvenile offenders in Canada such as the welfare, medical treatment, justice, crime control, community-based and restorative justice ones. In addition, the article analyzes the law making in Canada in terms of justice matters regarding to juvenile offenders to inlustrate these philosophies’ appearance. Accordingly, the article compares with the development of legislation in Vietnam in dealing with juvelile offender to see the similarities in the treatment ideologies over time. Finally, the article proposes recommendations to improve Vietnamese law relating to treatment of juvenile offenders in order to completely reflect the humanistic and model philosophies of treatment, based on learning experiences from Canada and inner demands of the actual law application in Vietnam.
