Labor subleasing contract - Current situation and some recommendations

Abstract

The provisions on labor subleasing contracts of the Labor Code 2019 have some new points compared to the past, meeting the flexible business and employment needs of employers in labor subleasing activities. However, during the implementation process, some provisions gradually revealed inappropriate points. On the basis of analyzing and evaluating the current situation of the provisions of the Labor Code 2019 on labor subleasing contracts, the article points out these inappropriate points, thereby proposing a number of recommendations for amendment and supplementation to further ensure the rights and obligations of the parties, especially the rights of the subcontracted workers in the current labor outsourcing activities in Vietnam.
