Improving some provisions under the 2015 Criminal Procedure Code to ensure the principle of presumption of innocence

Abstract

The principle of presumption of innocence is one of the fundamental principles in criminal procedure law. This principle orientates activities in criminal proceedings generally and proving crimes particularly in the course of handling criminal cases. The article presents common perception of the principle of presumption of innocence and then suggests to amend and supplement some provisions in the 2015 Criminal Procedure Code as the bases for where not prosecuting the accused, for discontinuing investigations, for giving up the case, or for deciding the accused innocent and determines the age of the victim who is under eighteen to ensure the principle of presumption of innocence.
