Extenuating circumstances in the application of administrative liability

Abstract

The enforcement of the law on sanctioning of administrative violations has proven the effects and importance of applying extenuating circumstances to individuals and organisations committing administrative violations, which help to materialise and differentiate levels of administrative liability. In the first part, the article presents the general provisions of the law on mitigating circumstances of administrative liability. Then, the article analyses shortcomings in the legal provisions on the influence of extenuating circumstances in the application of administrative liability measures. On that basis, the author proposes recommendations to improve the law.
