Compensation for damages after divorce – Perspectives from the 2020 Chinese Civil Code and experience for Vietnam

Abstract

The divorce relief system is a significant component of China's marriage and family institution, encompassing economic reciprocity for divorce, economic support for divorce, and compensation for damages after divorce. This article discusses Article 1091 of the 2020 Chinese Civil Code, which outlines the nature of the damages that can be compensated, the conditions for compensation, statute of limitations; and its application in Chinese judicial practice. Based on this analysis, the author will make relevant recommendations for Vietnamese law on adressing the same issue.
