Some existing legal issues about auction of land use right for allocation with land use fees and land leasing

ABSTRACT
Putting land use rights into auction is a step forward in the State's land allocation and lease activities. Through the implementation, it will contribute to reducing land speculation, creating a healthy competition among auction participants, and mobilizing maximum capital for the state budget. This activity is governed by a complex legal system and a variety of legal documents. This article focuses on clarifying some basic contents about auction of land use rights for land allocation and land lease, and at the same time clarifying six shortcomings that still exist in the practical application of legal provisions on auctions of land use rights. And thereby asking for amendments and supplements in regulation in order to improve the quality and efficiency of law enforcement and maximize the role of land use right auction in the development of the country.
