Improving sentencing policies for property appropriation offenses in Vietnam

This article provides an overview of the current sentencing policy for property appropriation offences under Vietnamese Penal Code; identifies shortcomings and conducts a comparative analysis with the legal frameworks of selected countries including Germany, Japan and the United States. Based on this analysis, the article proposes directions for improving the sentencing policy through the incorporation of restorative justice principles, the development of a specialized system for handling economic crimes, and the integration of criminal and civil mechanisms. These reforms aim to enhance the humanity, effectiveness, and victim restitution capacity of the criminal justice system.
