Court-assisted evidence collection in civil proceedings: A comparative study of Vietnam and China

Abstract

Evidence plays a central role in civil proceedings, serving as the basis for courts to identify objective facts and render lawful judgments. While the principle that “parties bear the burden of providing and proving evidence” is widely recognized, both Vietnam and China stipulate mechanisms for courts to assist in evidence collection to ensure access to justice. This article analyzes and compares the legal provisions and practical application of this principle in the two countries, and proposes recommendations for improving Vietnam’s civil procedure law.
