Thực trạng và một số kiến nghị hoàn thiện pháp luật hiện hành về dây họ

Abstract

"Họ, hụi, biêu, phường" (hereinafter referred to as "họ") is a form of property transaction in accordance with customary practice on the basis of an agreement reached by a group of people who assemble together and jointly determine the number of people, the term, the amount of money or other property, the form of contribution and payment of "họ", and the rights and obligations of the members of the group.  "Họ" is aimed at mutual assistance of citizens and shall be implemented in accordance with law. The paper concentrates on analyzing the legal status of “họ”; thereby, the author proposes some recommendations to improve the law about this matter.
