Structures and legal relationship of parties in guarantee

Abstract

In civil and commercial relations, parties often choose guarantee as a security measure due to its convenience. The article aims to identify the structures and legal characteristics of the obligation relationship created by the guarantee and its validity as well as contributes to clarifying the rationale for the application and enforcement of the guarantee law, especially in bank guarantees.
