Recidivism and dangerous recidivism in Vietnamese criminal law – Current situation and recommendations

Abstract

Recidivism and dangerous recidivism is either a circumstance that aggravates criminal liability in sentence decision or a fundamental element in some crimes in the Penal Code. By researching and applying in reality, it is shown that there are still obtacles in applying these two factors. Therefore, this article points out inconsistent perceptions and proposes timely application instructions to resolve criminal cases.
