Evaluating compatibility between regulations of Vietnamese Penal Code on bribery and the United Nations Convention against Corruption

Abstract

The 2015 Penal Code, amended and supplemented in 2017 has internalized many regulations of the United Nations Convention against Corruption (UNCAC). However, its provisions on bribery on Article 364 are only partially compatible with the requirements of criminalizing corruption crimes under the UNCAC. Therefore, based on the requirements of the UNCAC, it is necessary to continue perfecting the 2015 Penal Code’s provisions on this crime.
