Perfecting provisions of the 2015 Criminal Procedures Code on emergency custody belongs to preventative measures

Abstract

The measure of emergency custody specified in the 2015 Criminal Procedure Code are based on the measure of emergency arresting in the 2003 one to ensure the human rights and citizen rights in criminal proceedings recognized in the 2013 Constitution. However, when applying this measure, it has witnessed some limitations making difficulties to bring defendants into account. Therefore, the author gives out some suggestions to perfect regulations on emergency custody in the 2015 Criminal Procedure Code.
