Methods to analyse and identify defendant’s counterclaim in resolving civil cases

Abstract

The acceptance and resolution of counterclaim make a significant contribution to support the Judge resolves the case objectively, comprehensively and thoroughly. However, there is still disagreement and misunderstanding in scientific analysis method to correctly identify the counterclaim which is considered as an important factor to accept the counterclaim accurately. This paper sheds light on theoretical and practical matters on the acceptance and resolution of counterclaim in resolving civil cases.
