Comments on legal consequences in case private enterprise owner dies under Article 193 of the 2020 Enterprise Law

Abstract

The 2020 Enterprise Law has new regulation on rights of private business owners in some special cases, in which Clauses 2 and 3 provide legal consequences when private enterprise owner dies. It has been considered as a positive point of the 2020 Enterprise Law because it has limited many disputes related to inheritance and decided the "fate" of private enterprises. However, this regulation also has remained several shortcomings that need further guidance and improvement.
