Abstract

   Nowadays, the declaring land use rights (LUR) transfer prices on contracts was often lower than actual land prices. The study was conducted to assess the situation of LUR transfer, and the fluctuations of land price from 2019 to 2023 in Chuong My district, Hanoi. Data on the number of transactions for LUR transfer and contracts in certain sites in the period of 2019 - 2023 was gathered from land registration agencies; the actual land prices were collected through interviews with commune-level cadastral officers, land brokers, or land users. According to the research findings, LUR transfer transactions in Chuong My district were on the rise from 2019 to 2023, with a market land price increase rate of 8,95%, and land prices in rural residential areas are 2,46 times higher than those in urban areas, national highways, and provincial roads. The price stated in the transfer contract is always low and only equal 48,9% of the actual transfer price on the market while Hanoi City's land price table only shows 29,88% of the transfer price on the market. To manage the declaration of transfer prices for land use rights, authorities must construct a land price table that satisfies the market price for taxes and fees and encourage land users to honestly declare land prices; control people's income and have strict sanctions for violations during the transfer.
